Filing Saarthi

Terms & Conditions

Filing Saarthi is the compliance and advisory platform of SPL Chopra Consultancy Private Limited, registered office at 28 Riddhi Siddhi, Nagar VIIth, Lalchandpura, Niwaru Road, Jaipur, Rajasthan – 302012.

When you browse this website or engage us for any service, you're agreeing to the terms set out below, together with our Privacy Policy. Please read them before you proceed, if any part doesn't work for you, we'd rather you stop here than sign up under a misunderstanding.

We do update these terms from time to time as our services, and the law around them, evolve. We won't email you every time this happens, so it's worth checking back occasionally. Using the platform after an update means you're on board with the new version.

1. How GST Applies to Our Pricing

Every price you see on filingsaarthi.com is a final, all-in figure, GST is already built in. What's quoted is what you pay; there's no tax added at checkout.

That said, if you'd like a GST compliant e Invoice with Input Tax Credit, we need your GSTIN entered before or at the moment of payment. This isn't something we can retrofit afterward, so please double check this at checkout, we won't be able to reissue an invoice for ITC purposes once the transaction is closed.

Where a service involves incorporation, licensing, or trademark filing, any government fee involved is called out separately on your invoice upfront. We simply collect it and pass it through to the relevant authority; it isn't our fee.

2. Using This Website

Keep your details current. Whatever you tell us for identification, contact, or business purposes, needs to be accurate and kept up to date. We build our filings and advice on what you give us.

Your account, your responsibility. Whoever holds your login is presumed to be acting on your behalf, so guard your credentials. Once we've granted you access to the platform, that fulfils our obligation for that stage of the engagement, what happens with your account after that, and the outcomes that follow, sit with you.

Play fair with the platform. Don't try to access filingsaarthi.com through scripts, scrapers, or any route other than the front door. Don't do anything that could disrupt our servers or infrastructure. And please don't copy, resell, or repackage what we've built here, it took real work to put together.

If any of the above is breached, you're on the hook for whatever loss or liability follows, including criminal exposure where applicable, not just something we write off.

If we ever open comment sections, reviews, or forums: we won't be actively policing every post, but we do reserve the right to take down anything that's unlawful, abusive, defamatory, misleading, infringing, or pretending to be Filing Saarthi staff. We're not liable if something slips through before we catch it. Content you willingly post through these open channels, as long as it's not infringing someone else's rights, can be used, adapted, and published by us without further permission.

Indemnity, plainly put: if your breach of these terms or someone else using your account, causes us a loss, you agree to cover it, including reasonable legal costs. If a claim comes in that we're entitled to be indemnified for, we may choose to run the defense ourselves, and we'll expect your cooperation if we do.

3. Privacy

How we handle your personal data, collection, storage, use, and protection, is spelled out in our separate Privacy Policy, which forms part of this agreement.

4. What We Can and Can't Promise

We provide this platform and our services as they stand, as available, we don't promise it will be error free or uninterrupted, and we make no warranty of fitness for a particular purpose beyond what's expressly agreed.

If something does go wrong on our end, our liability is capped at the amount you actually paid us for that specific service, not any downstream cost or consequence you might incur. We're not responsible for indirect or consequential loss, including data loss, business disruption, or a period without access, to the extent the law allows us to limit this.

5. What Belongs to Us

The text, design, code, and branding on this site are the property of SPL Chopra Consultancy Private Limited, protected under Indian copyright and trademark law. If you'd like to reuse any of it, ask us first, we're generally reasonable about it, but it needs our sign off.

6. If We Need to Suspend or End Access

We hope this never comes up, but we reserve the right to suspend or close your account, with or without advance notice, if these terms are breached, or if we reasonably suspect fraud or misuse. Where warranted, we may also refer the matter to law enforcement. Once access ends, associated data on file may be deleted from our systems.

7. Governing Law

This agreement sits under Indian law, and any dispute goes to the courts of Jaipur, Rajasthan, you're agreeing upfront to that jurisdiction and waiving objections about venue or convenience.

9. Company & Business Registration Services

Opening a bank account? With your go ahead, we'll pass your name, phone number, and email to the bank you choose. Whether they open the account is entirely their call, based on their own policies.

• Registering a Partnership Firm with the Registrar of Firms brings its own state specific fee, which we'll flag before you commit.

Name approval (RUN): you get up to 4 name options per application.

• Quick clarification on capital terms, authorised capital is the ceiling on how many shares a company could issue (raisable later); paid up capital is what shareholders have actually put in, and legally that can be as little as ₹2.

• Statutory Auditor fees are paid directly to the auditor, on actuals, this isn't something we bill you for. Every company is required to appoint one within 30 days of incorporation.

• With each incorporation, we include 2 DSC hyper tokens plus KYC and shipping support. Per current CCA guidelines, the certificate fee and KYC charge go directly to the Certifying Authority, that's a separate payment from us.

• Need more authorised capital than your package covers? We can quote that separately at the time of incorporation.

10. Trademark, Patent & Copyright Services

• Our quoted price covers one class, additional classes cost extra.

• We don't suggest or vet trademark names for you, and we can't promise a name is available or that it'll ultimately register.

• You're responsible for the accuracy of what goes into the application forms; if something's wrong or incomplete on your end, we can't be held liable for the fallout.

• Objections, oppositions, refusals, and Show Cause Hearings are decided by the Trademarks Registry, entirely outside our control, and outside our liability.

• We'll support you through the process as best we can, but registration itself is the Registry's call, not ours to guarantee.

• Tracking your application's status on the IP India portal is on you, we're happy to help if you ask, but it's not something we automatically monitor.

• Confidentiality of your data holds, unless a court, government body, or the law itself requires disclosure.

11. Tax & Ongoing Compliance Services

• What you get depends on the package you've chosen, and we invoice periodically as work is completed.

CA verification of an Income Tax Return is billed as a separate line item, not bundled by default.

• Before anything gets filed, it's on you to check that the return, filing, or accounting record we've prepared is accurate and complete, and to tell us anything relevant we should know. We can only work with what you've given us, so incomplete or incorrect inputs aren't something we can be liable for.

• Your data stays confidential with us and won't go to third parties without your say so, except where the law, a court, or our professional obligations require otherwise. If you give us permission (or set conditions) to share something specific, we'll follow exactly what you've authorized, in writing.

Government fees, penalties, statutory audit costs, and taxes are all client borne, paid on actuals. Our job is preparing the books and filings, not footing government bills.

• We'll need reasonable, timely access to the people and paperwork relevant to your engagement, the completeness of what's supplied is on your side.

• Any advice we give is shaped by what you've told us about your specific situation, it's only as good as the facts we're working from.

• Compliance deadlines under the various applicable laws are ultimately your responsibility to track; penalties from missed compliance sit with you, not us.

Our standard GST Return / TDS / ITR / PF Return pricing assumes turnover up to ₹25 lakh and a team of up to 25, beyond that, expect additional charges.

11.1 Partnership / Company / LLP Compliance  , Extra Detail

• Package pricing holds up to ₹25 lakh turnover; every further ₹25 lakh slab adds to the cost, scaled to complexity.

• The Tax & HR Assist package is priced for 5 employees, each additional headcount is billed on top.

• TDS is billed quarterly; ESI, PT, and PF are billed monthly.

• Packages assume up to 100 invoices a month; beyond that, it's charged in blocks of 500.

• Service credits (given occasionally to loyal or preferential clients) can only be redeemed against Filing Saarthi services, can't be converted to cash, and stay tied to the specific business they were issued for, they don't transfer.

11.2 Closing Down a Company or LLP

• A company that's never actually started business within a year of incorporation, or has sat dormant for two straight financial years without formally applying for dormant status under Section 455, with zero transactions, assets, or liabilities, qualifies for strike off.

• If you've received an STK 1 or STK 5 notice, every pending compliance needs to be cleared before STK 2 goes in, and the company must have actually commenced business. All directors need to be unanimously on board and sign off on the paperwork.

• Directors' DIN e KYC and DSC need to stay active right up until the MCA shows the company's status as “Under Process of Strike Off.”

• Don't close the current account while money, refunds, chargebacks, subsidies, is still owed to the company. Wind down only once everything owed has actually landed in the account; then it's safe to close.

• Cancelling Professional Tax, IEC, Trademark, or ESI/PF registrations tied to the company is handled offline by the authorized director directly with each department, that's outside what we file digitally.

• A few things make a company ineligible for strike off: a recent name change, shifting the registered office to another state, disposing of assets or rights, doing anything beyond what's needed for the strike off itself, an unresolved Tribunal application for compromise or arrangement, or an ongoing winding up under Chapter XX or the IBC, 2016.

• Section 8 companies, Nidhi companies, subsidiaries, and public limited companies can't use the STK 2 route at all.

• If you instruct us to file STK 2 without actually meeting the eligibility conditions, and it's rejected, that's not on us.

• More than 100 bank statement entries in the account brings an additional charge.

• The client covers the ₹10,000 (indicative) government strike off fee, stamp paper, notary charges, and any tax or penalty due.

• LLP closures carry an additional ₹1,000 government fee, and our listed pricing assumes the LLP has no assets or liabilities on its books.

• Updating the registered address or email, or adding/removing partners, each needs a separate MCA filing with its own charge.

• LLPs must file Form 3 within 30 days of incorporation, miss that, and the resulting penalty has to be cleared before we can even file Form 24 to close the LLP.

12. Refunds & Cancellations

We want you satisfied with what we deliver. If something's off, the fastest way to reach us is WhatsApp, on the mobile number you registered with, we'll look into resolving it, whether that's a fix, a refund, or credit toward a future service.

What “service complete” means for us: our obligation is met once you have platform access. From there, accuracy and follow through become your responsibility. We don't pay penalties or taxes on your behalf, and we're not liable for costs tied to how the underlying government process plays out.

If a refund is due, a 20% cancellation charge applies, that covers the work and resources already committed on our side.

To request one: email filingsaarthi@gmail.com or message us on WhatsApp, subject line "Refund Request – [Invoice/Order Number]", with proof of payment and your reason for cancelling.

Want a different service instead? Let us know within 7 days of your original purchase.

No surprise charges, our pricing is what it is. The one exception: if a government fee goes up, or a filing needs to be redone because of a rejection, that additional cost is passed on; it's not something we absorb.

Some things are simply out of our hands, a trademark can get refused for reasons that have nothing to do with our filing, and government portals (MCA, Income Tax, FSSAI) sometimes run slow or go down entirely. The same goes for outcomes delivered by independent professionals in our associate network who aren't Filing Saarthi employees. None of this qualifies for a refund, it isn't something we control.

Force Majeure: if we're stopped or delayed by something genuinely outside our control, natural disaster, epidemic, war, strikes, a change in law, and the like, we're not in breach for the resulting delay.

Putting a service on hold? Just say so, we'll keep your payment on file until you're ready to resume, rather than treating it as a cancellation.
