GSTR-9 is the annual return prescribed under Section 44 of the CGST Act 2017 for eligible GST registered taxpayers. It provides an annual summary of the information reported during the financial year through periodic GST returns along with other details required in the prescribed form.

Failure to furnish GSTR-9 within the applicable due date may result in late fee and other consequences under GST law.
Late Filing: Late fee under Section 47(2) applies for delay in furnishing the annual return. For eligible taxpayers the applicable rate is determined according to the turnover-based provisions introduced for annual returns.
For aggregate turnover up to ₹5 crore: Late fee is generally ₹50 per day comprising ₹25 under CGST and ₹25 under SGST/UTGST subject to the prescribed maximum of 0.04% of turnover in the State or Union Territory.
For aggregate turnover exceeding ₹5 crore and up to ₹20 crore: Late fee is generally ₹100 per day comprising ₹50 under CGST and ₹50 under SGST/UTGST subject to the prescribed maximum of 0.04% of turnover in the State or Union Territory.
For aggregate turnover exceeding ₹20 crore: Late fee is generally ₹200 per day comprising ₹100 under CGST and ₹100 under SGST/UTGST subject to the prescribed maximum of 0.50% of turnover in the State or Union Territory.
Additional Tax Liability: If the annual review identifies tax that was not paid or was short paid applicable tax interest and other statutory consequences may arise depending on the facts and applicable provisions.
Interest: Interest may apply to delayed payment of tax under Section 50 of the CGST Act 2017. The applicable rate and period should be determined based on the nature of the liability.
