End-to-end incorporation of a Section 8 Company (NGO) under the Companies Act, 2013, including name approval, Central Government licence, incorporation, PAN and TAN through the MCA Portal.
A Section 8 Company is a non-profit organization incorporated under Section 8 of the Companies Act, 2013, for promoting charitable objects such as commerce, art, science, sports, education, research, social welfare, religion, charity, environmental protection or any other object of public utility. Unlike other companies, a Section 8 Company applies its profits or income solely towards promoting its stated objectives and is prohibited from distributing dividends to its members.
The incorporation process is governed by Section 8 of the Companies Act, 2013, read with the Companies (Incorporation) Rules, 2014, and is carried out through the SPICe+ application on the MCA Portal. Upon satisfaction of the prescribed conditions, the Central Government (through the Registrar of Companies) grants a licence to operate as a Section 8 Company.
Our professionals assist in name reservation, drafting of the Memorandum of Association (MoA) and Articles of Association (AoA), preparation of incorporation documents, obtaining the Section 8 licence, incorporation, PAN, TAN and advisory on post-incorporation statutory compliances.
