A Trademark is a distinctive sign capable of distinguishing the goods or services of one person or business from those of others. Trademark registration is governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017, and is administered by the Controller General of Patents, Designs & Trade Marks (CGPDTM).
A registered trademark provides the proprietor with the exclusive right to use the mark in relation to the registered goods or services and to prevent unauthorized use by third parties. The registration process involves conducting a trademark availability search, determining the appropriate class under the Nice Classification, preparing and filing Form TM-A, responding to examination reports (where applicable), publication in the Trade Marks Journal, handling opposition proceedings (if any) and obtaining the Registration Certificate.
